According to the latest data, dog bite injuries are on the rise. As Ad Age reports, 2015 saw a 14% spike in dog bite injuries in postal employees. Why the increase? Officials believe the trend is due to the increase in online shopping.
“Dogs view mailmen as trespassers invading their space,” veteran New Jersey mailman Michael Micali told Ad Age. “Let’s face it: a dog doesn’t have much to do all day if the house is empty but to sleep and wait for the mailman who comes around the same time each day.”vIn 2015, 6,549 dog attacks on postal workers were reported, a 14% increase from the previous year. While the U.S. Postal Service—which delivers up to 40% of all Amazon packages—still insists that less than one percent of their carriers are harmed by pets annually, they have been rolling out new digital, handheld technology that will alert carriers to hazards before they are in harm’s way.
DISSECTING A DOG BITE CLAIM
Depending on the circumstances of an attack, a dog bite claim could fall into three separate categories: a dog biteclaim, a premises liability claim, or even perhaps workers’ compensation claim. For mail carriers who are visiting properties to deliver packages, their claims are likely to fall in either the latter two categories.
Mail carriers are generally considered licensees when it comes to premises liability law, which means they are owed a certain level of duty of care. If a dog owner has put up a well-displayed “beware of dog” sign, for example, their liability is probably minimized. If they have not, however, and the dog attacks, that mail carrier may have a claim against the dog owner. Otherwise, the carrier may have legitimate workers’ compensation claim.
